Each change will become effective and you will be deemed to have accepted such changes immediately upon such change being posted and notified to you. If you do not accept any change, please discontinue your use of the Platforms.
It is a pre-condition that our Services are only provided to those who are permitted to enter in legally binding relationships. Therefore, if there is any reason why you are not able to enter into legally binding relationships with Us, for whatever reason - do not use our Services.

Our Services allow you to use software on our system to browse betting events and odds and provide a technical means to place peer-to-peer bets, where one party acts as the layer of the bet ("Layers") and the other party places the bets.
Our Services and the Platforms employ proprietary technology to allow you to retrieve, view and maintain information and interact with smart contracts that may conduct transactions with Layers, but all within one convenient service.
When you click on any odds the system formats your proposed bet according to the public API of the smart contract and connects you to your wallet in order that you may make the appropriate API call in an easy to use manner. All data transfers take place on the blockchain using dedicated smart contracts.
You acknowledge and agree that when you are accessing and retrieving information from Layers using our software, we are not acting as your agents nor the agents on behalf of the Layers but that we are simply making available the Services and software to you by which you may access and transact with such Layers.
You agree that the Layers featured shall be entitled to rely on the foregoing authorisation and agency granted by you.
If you use this service as a Layer then the system will make the appropriate public API calls to smart contracts on the blockchain in order to confirm and result bets on your behalf. You are not obliged to use this system in order to make these API calls, xfun.bet is provided as a convenience to assist you with the process.
XFun.bet Technology receives odds directly from Layers, using technology to ensure publishing as close to real-time as possible. All of the odds shown remain the property and responsibility of the Layers themselves. All odds data is shown in good faith and does not guarantee its availability or accuracy. XFun.bet Technology does not accept liability for errors in prices, odds, incorrectly calculated winnings, events or markets shown on the platforms or odds changes prior to a bet being placed and will not be liable for any loss suffered by any party if the service is unavailable or inaccurate in any way.
Please ensure you check all your bet details are correct before placing a bet. You are solely responsible and liable for all activity that occurs on your account.
In the event that there are system errors which cause bets to be offered incorrectly the system may cancel these bets and return the relevant stake and risk to Bettor and Layer respectively at its sole discretion.
As a Layer when using the lay.xfun.bet application a 1% fee will apply on any earnings. This 1% fee as XFUN will be burned, reducing the circulating supply of XFUN and FUNToken. By becoming a Layer on XFUN.bet you agree to this condition. The 1% fee does not apply to any losses.
You accept that Services are provided to you "as is" with any faults or failings and any representation, warranty, condition or guarantee whatsoever, express or implied (including, without limitation, any implied warranty of accuracy, completeness, uninterrupted provision, quality, merchantability, fitness for a particular purpose or non-infringement) excluded to the fullest extent permitted by law.
Under no circumstances (including, without limitation, negligence) are we liable for any injury, loss, claim, loss of data, income, profit or opportunity, loss or damage to property, general damages or any direct, indirect, special, incidental, consequential, exemplary or punitive damages of any kind whatsoever arising out of or in connection with your access to, or use of, or inability to use, our Services, any software, any materials or other information on the Platforms for any goods, materials or services available therefrom (whether based in contract, tort and whether negligent or otherwise), even if we have has been advised of the possibility of such damages or loss or that such loss was foreseeable.
You specifically acknowledge, agree and accept that we are not liable to you for any of the following:
Nothing in these terms shall operate so as to exclude or restrict our liability for death or personal injury caused by our negligence.
If any term of these Terms & Conditions is or becomes illegal, invalid or unenforceable, that will not affect the legality, validity or enforceability of any other term of these Terms & Conditions.
These Terms & Conditions shall be governed and construed in accordance with the Laws of Costa Rica and You irrevocably agree to submit to the exclusive jurisdiction of the Costa Rica Courts.
